By accessing our website, creating an account, placing an order, enrolling in a subscription or membership, or otherwise using our services, you agree to these Terms of Service and any policies incorporated into them by reference.
Please read these Terms carefully. If you do not agree to them, do not use our website or services.
1. Eligibility and Account Responsibility
You must be at least the age of majority in your state of residence to make a purchase or create an account. A parent or legal guardian may allow a minor to use the website under their supervision.
You are responsible for:

3. Products and Product Information
We make reasonable efforts to accurately describe and display our products. Because our products include agricultural and naturally raised foods, individual items may vary in appearance, color, shape, marbling, texture and weight.
Product photographs are illustrative and may not depict the exact item you receive. Packaging, labeling, availability and product specifications may change without notice.
Some products may be listed using estimated, average or approximate weights. Natural variation is expected. Any applicable weight ranges or pricing methods will be disclosed on the product page.
We may limit product quantities, discontinue products, restrict sales by location or decline orders that appear to be intended for unauthorized resale or distribution.
4. Food Information and Safe Handling
Unless expressly stated otherwise, our meat, poultry, seafood and other perishable products require refrigeration or freezing and proper food handling.
You are responsible for:

Inspecting perishable products promptly upon delivery

Refrigerating or freezing products immediately

Following applicable cooking and food-safety instructions

Avoiding cross-contamination

Checking ingredients and allergen information before consumption

Consulting a qualified professional when you have a medical condition, allergy or dietary concern
Dry ice may completely evaporate during shipping. An empty dry-ice bag does not, by itself, mean that the products are unsafe.
Perishable products should arrive frozen, partially frozen with visible ice crystals, or at a temperature of 40°F or below when measured with a food thermometer. Do not consume products that arrive above 40°F or show signs of spoilage, contamination or damaged packaging. Contact us immediately for assistance.
Information on our website concerning nutrition, wellness, farming practices or food is provided for general educational purposes. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease.
5. Orders and Order Acceptance
Submitting an order is an offer to purchase the products in your cart. An automated order confirmation acknowledges that we received your order but does not guarantee final acceptance.
We may accept, reject, limit or cancel an order for reasons including:

Suspected fraud or unauthorized activity

Orders that appear intended for unauthorized resale

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled portion.
Once fulfillment has begun, we may not be able to change or cancel an order.
6. Pricing, Payment and Taxes
Prices are displayed in United States dollars unless otherwise stated. Prices, promotions, product availability and shipping charges may change without notice.
You authorize us and our payment processors to charge the payment method you provide for your order, including applicable taxes, shipping fees and recurring charges you have expressly authorized.
You agree to provide complete and accurate billing information and to keep your payment information current.
We may correct pricing, promotional or product-description errors at any time. If an error affects an order you have already submitted, we may contact you for approval of the corrected terms or cancel and refund the affected item.
Discount codes, credits and promotions:

Have no cash value unless required by law

May be canceled when obtained or used fraudulently

May be restricted to particular products, customers or purchase amounts
7. Shipping and Delivery
Our Shipping Policy is incorporated into these Terms by reference.
Shipping dates and delivery estimates are estimates, not guarantees. Delivery may be affected by carrier delays, weather, natural disasters, road conditions, holidays, incorrect addresses, access restrictions and other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, losses or spoilage caused by:

An incorrect or incomplete address provided by the customer

A recipient’s failure to retrieve or open a package promptly

Refused deliveries

Delivery to an unattended location

Delivery restrictions at apartments, gated communities, businesses or other locations

A customer’s request to delay, reroute or hold a shipment with the carrier
You should arrange for someone to receive and inspect perishable deliveries promptly.
Ownership and risk of loss pass to you when the order is delivered to the shipping address you provided, except where applicable law requires otherwise.
8. Damaged, Delayed or Incorrect Orders
Inspect your order immediately after delivery.
To request assistance for a damaged, unsafe, missing or incorrect order, contact us within 24 hours of delivery and provide:

Photographs of the shipping box, shipping label, packaging and affected products

The temperature of affected perishable products when relevant

Any additional information reasonably needed to evaluate the claim
Do not consume or discard affected products until we respond, unless keeping the product would create a health or safety concern.
Depending on the circumstances, we may provide a replacement, store credit, partial refund or full refund. The appropriate remedy will be determined based on the nature of the issue, product availability and applicable law.
Failure to report an issue within the stated period may limit our ability to verify the claim or obtain reimbursement from the carrier. This does not limit any rights that cannot legally be waived.
9. Returns and Refunds
Because we sell perishable food products, we generally do not accept physical returns.
Refunds and replacements are available only as described in our Refund Policy or when required by law. We do not provide refunds because of personal taste preferences, minor natural product variation or a customer’s failure to properly receive, refrigerate, freeze, store or prepare a product.
Approved refunds will generally be issued to the original payment method. Processing times vary by financial institution.
Our Refund Policy is incorporated into these Terms by reference.
10. Subscriptions and Automatic Renewals
Certain products, memberships or services may be offered on a recurring or automatically renewing basis.
Before you enroll, we will disclose the material subscription terms, including:

The length of any initial or renewal term

Whether and how the subscription automatically renews

By enrolling and providing your affirmative consent, you authorize Primal Pastures to automatically charge your selected payment method at the disclosed frequency until you cancel.
Prices, taxes, shipping charges and available products may change as permitted by law. When legally required, we will provide advance notice of material changes or price increases.
Cancellation
You may cancel an online subscription through the online cancellation method provided in your customer account or through another cancellation method identified in your subscription confirmation.
Cancellation stops future renewals. It does not automatically cancel or refund an order that has already been processed, packed or shipped, except where required by law or expressly approved by us.
To avoid the next recurring charge, you must cancel before the applicable processing or renewal deadline disclosed when you enroll or in your account.
We will provide subscription acknowledgments, renewal notices, annual reminders and other notices when required by applicable law.
If a recurring payment fails, we may retry the payment method, request updated payment information, pause fulfillment or cancel the subscription.
The specific terms presented when you enroll form part of these Terms. If those specific terms conflict with this section, the enrollment terms will control for that subscription to the extent permitted by law.
11. Farm Memberships and On-Site Activities
Farm memberships, farm visits, classes, tours, events, volunteer activities, harvesting and other on-site experiences may be governed by additional terms, rules, releases or waivers.
Access to Primal Pastures property may require:

A valid membership, reservation or ticket

Agreement to farm rules

Execution of an assumption-of-risk and liability waiver

Parent or guardian consent for minors
-
Compliance with staff instructions
-
Appropriate supervision of children and guests
Farms contain inherent risks, including animals, insects, plants, agricultural equipment, vehicles, uneven ground, mud, dust, weather, water, fences and other natural or operational conditions.
These Terms do not replace any separate farm waiver, membership agreement or event-specific terms. When separate documents apply, you must agree to them before participating.
We may suspend or revoke farm access for unsafe, disruptive, abusive or unauthorized conduct or for violations of farm rules.
12. Loyalty Program
Participation in our loyalty program is subject to the program terms displayed on the website or through the applicable loyalty platform.
Unless otherwise stated, loyalty points may not be earned on:

On-site classes

Beef shares
-
Eggs
-
Items purchased in person

Products or transactions specifically excluded from the program
Points have no cash value, are not transferable and may be subject to expiration or redemption restrictions.
We may modify, suspend or terminate the loyalty program, earning rules, redemption values or eligible products. When reasonably possible, we will provide notice of material changes.
We may cancel points or accounts associated with fraud, abuse, returns, chargebacks, unauthorized activity or violations of these Terms.
13. Gift Cards and Store Credit
Gift cards and store credits may be subject to separate terms presented at purchase or issuance.
Gift cards:

Are redeemable only for eligible Primal Pastures purchases

Cannot be redeemed for cash except where required by law

Should be treated like cash

May not be replaced if lost, stolen or used without authorization, except where required by law
Promotional credits may expire and may have additional restrictions. Purchased gift cards will be treated in accordance with applicable law.
14. Intellectual Property
The website and its content, including text, photographs, videos, graphics, recipes, logos, trademarks, product names, designs, icons and software, are owned by or licensed to Primal Pastures and are protected by applicable intellectual-property laws.
You may view and use website content for personal, noncommercial purposes. You may not reproduce, modify, publish, distribute, sell, license, create derivative works from or commercially use our content without prior written permission.
“Primal Pastures” and associated names, marks and logos may not be used without written authorization.
15. Reviews, Comments and Other Submissions
When you submit a review, photograph, testimonial, comment, suggestion or other content to us, you represent that:

You own or have permission to submit the content

The content is accurate and not misleading

The content does not violate another person’s privacy, publicity, copyright, trademark or other rights

The content is not unlawful, threatening, defamatory, obscene or harmful

You retain ownership of your original content. You grant Primal Pastures a worldwide, nonexclusive, royalty-free, transferable and sublicensable license to use, reproduce, edit, publish, display, distribute and create derivative works from the content in connection with our business, marketing and services.
We are not required to use, compensate you for or respond to submissions. We may remove content that violates these Terms or that we reasonably consider inappropriate.
16. Privacy
Our collection, use, disclosure and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
Our Privacy Policy and privacy-request tools may be hosted or supported by a third-party privacy compliance provider.
You may review our privacy practices and submit applicable privacy requests through our Privacy Policy or Privacy Center.
We may choose to provide certain privacy choices or request mechanisms even when not legally required to do so. Providing a voluntary privacy choice does not establish that a particular privacy law applies to Primal Pastures or create rights beyond those provided by applicable law and our published Privacy Policy.
17. Email, SMS and Marketing Communications
When you provide your email address or telephone number, you may receive transactional communications concerning your orders, account, deliveries, subscriptions or memberships.
Marketing emails and text messages are subject to the consent terms presented when you enroll and any separate Email or SMS Terms.
Consent to receive marketing communications is not a condition of purchasing products unless expressly permitted by law. You may unsubscribe from marketing emails or text messages using the instructions provided in the communication.
Unsubscribing from marketing messages will not prevent us from sending necessary transactional or service-related communications.
18. Third-Party Services and Links
Our website may use or link to third-party platforms, including payment processors, shipping carriers, subscription providers, loyalty platforms, analytics providers, social media services and other technology providers.
Third-party services are governed by their own terms and privacy practices. We do not control and are not responsible for third-party websites or services.
A link to or integration with a third party does not necessarily mean that we endorse or guarantee that third party.
19. Disclaimer of Warranties

To the fullest extent permitted by law, our total liability for a claim relating to an order, product or service will not exceed the amount you paid to Primal Pastures for the specific order, product or service giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct or other matters for which limitation is prohibited by law.
Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted.
21. Indemnification
You agree to indemnify and hold harmless Primal Pastures, LLC and its owners, officers, employees, agents and service providers from third-party claims, liabilities, losses and reasonable costs arising from:

Unless applicable law requires otherwise, any legal action arising from or relating to these Terms, the website, an order or our services must be brought in the state or federal courts located in Riverside County, California. You and Primal Pastures consent to the personal jurisdiction of those courts.
25. Changes to These Terms
We may update these Terms to reflect changes in our business, services, policies or legal obligations.
The updated Terms will be posted on this page with a revised “Last Updated” date. When required by law, we will provide additional notice of material changes.
Your continued use of the website after updated Terms become effective constitutes acceptance of the updated Terms. Changes will not apply retroactively where prohibited by law.
26. Severability
If any provision of these Terms is found unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
27. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

We may assign these Terms as part of a merger, acquisition, financing, corporate reorganization, sale of assets or transfer of our business, subject to applicable law.

If separate terms apply to a particular subscription, membership, event, promotion or service, those separate terms will control to the extent of a direct conflict.
